
In January at CES 2025, Genki generated quite a stir by displaying a prototype for the Switch 2, several months prior to Nintendo’s formal announcement of the console. This premature reveal sparked controversy when Nintendo filed a lawsuit against Genki in May over their unauthorized lineup of Switch 2 accessories. However, the legal dispute has since been resolved with a settlement, and Genki is now required to compensate Nintendo for any damages incurred.
The court has recorded a decision in favor of Nintendo against Genki, with damages yet to be disclosed publicly due to confidentiality between the parties (as reported by IGN). Following CES 2025, controversy arose when Nintendo allegedly confronted Genki about a prototype Switch 2 model on display at their booth. Yet, Genki maintains they never agreed to any nondisclosure agreement with Nintendo and thus aren’t bound by any legal restrictions.
According to the court ruling, Genki has disputed claims that it had early access to a Nintendo Switch before its official announcement or release. Additionally, Genki has been legally barred from using any of Nintendo’s logos, designs, or specific terms such as Glitch, Glitch 2, Genki Direct, and Genki Indirect, which seem to reference protected intellectual property or branding belonging to Nintendo.
Genki continues to produce accessories designed for the hypothetical Switch 2, however, it’s important to note that these items have not received official licensing nor endorsement from Nintendo.
Apart from their court victory this week, Nintendo scored another win as Ryan Michael Daly was mandated to compensate Nintendo with a sum of $2 million due to selling customized Switch consoles capable of playing unauthorized games. Furthermore, Daly is forbidden by law to breach Nintendo’s digital rights and assist others in similar activities going forward.
