
Okay, so Mizkif sued me for defamation, but I just filed a motion to get the case thrown out. Basically, I’m arguing he doesn’t actually have a case, and that everything I said was based on stuff Mizkif already admitted to publicly. It feels like he’s trying to come after me for just… talking about what he’s already said himself, which doesn’t seem right.
Mizkif filed a lawsuit in November 2025 against several people and companies, including fellow streamer Emily ‘Emiru’ Schunk, OTK Media, Mythic Talent Management, and King Gaming Labs. The lawsuit centers around disagreements over business dealings and claims of damage to his reputation.
The lawsuit against Mizkif centers around problems with his business and personal life, specifically disagreements over contracts and statements he made publicly after releasing a video. Some of the companies involved are trying to move the case to private arbitration, but that request is still being considered.
On February 5th, Asmongold’s legal team asked the court to dismiss the case, claiming Mizkif doesn’t have a valid claim for defamation.
Asmongold files motion to dismiss Mizkif lawsuit
A legal motion was submitted to a federal court in Texas, requesting the case be dismissed. If the court doesn’t dismiss it, the motion asks Mizkif to clearly specify the exact statements he claims are defamatory.
Mizkif is suing over comments made about him, but his lawsuit doesn’t mention that he initially made public statements which prompted those comments. He’s considered a public figure, and the lawsuit leaves out important background information.
According to the legal filing, Mizkif is deliberately withholding important details because revealing them would demonstrate that his complaints don’t actually constitute a valid defamation case.
Asmongold’s lawyers highlighted several public statements Mizkif made before the controversy began. They cited instances where Mizkif admitted to aggressive behavior, including damaging property and experiencing intense anger linked to steroid use. Specifically, Mizkif had stated he ‘punched holes in the walls or slammed doors in aggression’ and that he ‘did take steroids that gave me insane anger issues.’
Mizkif reportedly said, “If she comes after me, I’ll retaliate strongly.” He confirmed this was his exact statement and indicated he intends to follow through with that response.
The legal filing claims that commentary on these statements isn’t considered defamation according to Texas law. It argues that Mizkif can’t sue Hoyt for defamation just for repeating and agreeing with things Mizkif himself already said.

The defense argues that Mizkif’s complaint doesn’t clearly state what specifically was said that was defamatory. They claim the lawsuit lacks complete quotes, doesn’t cite sources, and doesn’t specify where the alleged defamatory statements were published, making it impossible for the court to properly assess the claims.
Asmongold contends that the comments in question are protected by the Constitution as opinions, not statements that can be proven true or false. His argument, and the legal motion, frame the commentary as fair reporting and personal opinions expressed by Mizkif himself.
Because Mizkif and the other party are well-known public figures, the lawsuit requires Mizkif to prove ‘actual malice’ with strong evidence. However, the statements in question are based on things Mizkif himself already publicly admitted, making it impossible to meet that high standard of proof.
Asmongold is requesting the court to either throw out Mizkif’s defamation lawsuit completely, or to require Mizkif to provide a more detailed explanation of his claims if he wants to continue the case.
Asmongold’s request to the court focuses solely on the accusation that he was personally defamed. A decision on this request hasn’t been made yet, and the overall case is still in progress.
