Recall that the lawsuit’s start was in December 2020 when the watchdog accused the company of illegally raising more than $1.3 billion in an unregistered securities offering. Ripple opposed the claims, arguing that its native token should not be classified as such investment, thus not falling under the jurisdiction of the agency.

Recently, Magistrate Judge Sarah Netburn issued a new scheduling order that requires the Securities and Exchange Commission (SEC) to file its response to Ripple’s motion for remedies and entry of final judgment today, April 29. I expect the SEC to comply with this requirement. Meanwhile, Ripple has been given three business days, until May 3, to submit their reply.
Many industry players considered Judge Netburn’s participation a good sign for Ripple’s potential victory in the ongoing case, given her historically favorable view of XRP. Approximately three years ago, she expressed the opinion that Ripple’s native cryptocurrency possesses unique functionalities that distinguish it from Bitcoin and Ether.
