A U.S. federal court has thwarted President Donald Trump’s efforts to impose significant tariffs worldwide, a move announced in April that caused global markets to react dramatically. The president aimed to utilize the International Emergency Economic Powers Act to enforce these tariffs, but a panel of three judges overturned this decision. At present, it remains unclear how this court ruling will impact the potential release of the Switch 2 and other gaming devices.
According to the decision, there’s a possibility that Trump can impose tariffs of 15% on specific countries with which the U.S. has a substantial trade imbalance, for a period of approximately 150 days.
According to George Mason University professor Ilya Somin, who was involved in a similar tariff case, it might become necessary for companies who paid tariffs to receive those payments back.
If the appeal by the U.S. Justice Department is successful, there’s a chance that the case might reach the U.S. Supreme Court for review.
As a dedicated fan, I can share that Nintendo attributed the initial delay in Switch 2 preorders to Trump’s tariffs. Despite maintaining the $450 price point for the Switch 2, they did bump up prices on certain accessories. Interestingly, Microsoft increased Xbox console prices due to “market conditions,” without explicitly mentioning tariffs. In a similar fashion, Sony raised PS5 prices in April. Even tabletop gaming companies have felt the impact of these tariffs.
It’s uncertain if gaming companies have included tariff costs within their price hikes, and it remains vague whether these companies plan on providing refunds for these increased prices.
Gaming firms could increase prices due to multiple factors, even if tariffs aren’t a major concern. A common consensus among experts is that consumers are prepared and eager to spend more on their preferred items, as history shows they do. For instance, the new Switch model costs approximately $50 more than its predecessor, accounting for inflation, suggesting Nintendo might be charging higher prices because customers are willing to pay it.
