Texas Man Seeks $1M from Whataburger for Allergic Reaction to Onions on Burger!

A well-known quick service restaurant, Whataburger, faces a lawsuit worth almost $1M, as a customer claims he was served onions on his burger even though he explicitly requested no onions.

An incorrect order at Whataburger might lead to significant expenses for the restaurant, as a customer alleged that the inclusion of onions led him to sustain personal harm.

On the 25th of April, Demery Ardell Wilson initiated a legal action against Whataburger, stemming from a disagreement over orders that happened exactly one year earlier, specifically on the 24th of July, 2024.

As a dedicated fan, I’d like to share that, per the court case, when I ordered a burger, I explicitly asked for no onions. It’s worth noting that their usual burger comes with a beef patty, mustard, tomato, lettuce, pickles, and diced onion, all nestled within a bun.

Yet, upon taking a bite of his burger, the man unfortunately suffered from an allergic response since the onions hadn’t been taken out.

Man suing Whataburger over onions also sued Sonic

The Daily Mail reports that Whataburger has demanded “strict proof” over the claims.

As a gamer, I’d put it like this: “I want to clarify that I had no idea the item I bought from them was faulty or dangerously unsafe when I initially got it.

Wilson’s court filing states he’s seeking “monetary relief over $250,000 but less than $1,000,000.”

Previously, Hadi Law Firm, which is handling Wilson’s case, has collaborated with him in another legal matter concerning Sonic drive-in.

In April 2023, Wilson asserted that he required medical care due to feeling unwell, as his burger contained onions.

In that particular case, Sonic is seeking a jury trial. Similar to Whataburger, they think it’s Wilson’s responsibility to substantiate the claims and accusations made against them.

It’s not unprecedented for a fast-food company to face lawsuits; for instance, in the year 2020, a delivery person received a $50 million settlement following an incident where a hot Starbucks beverage spilled on him, causing severe burns.
