At CES 2025, gaming accessory maker Genki unveiled a new line of accessories for the yet-to-be-announced Nintendo Switch 2. Interestingly, they used a 3D-printed model of the console as a reference. However, this model has now attracted legal action from Nintendo, who have filed a lawsuit against Genki, claiming “trademark violation, unjust competition, and misleading advertising.”
The legal document claims that Genki violated several laws when advertising products marketed as “unauthorized Nintendo Switch 2 add-ons,” which Nintendo claims could cause confusion for prospective Switch 2 users. The paperwork also mentions various marketing strategies employed by Genki, such as a “Genki Direct” live stream that coincided with the April broadcast of the Nintendo Switch 2 Direct, and visuals displayed at CES 2025 featuring an unannounced console.
The lawsuit states that consumers may mistakenly believe there’s a relationship between the defendant and Nintendo or its partners. If consumers buy or preorder Genki’s products thinking they are genuine, endorsed, or approved by Nintendo, they might incorrectly attribute any flaws, issues, or poor quality in Genki’s products to Nintendo due to Genki’s actions.
After the lawsuit, Genki has addressed the situation on social media, stating that they are giving it careful consideration while collaborating with legal advisors to respond appropriately. The post also mentioned that they will persist in their preparations to meet orders and exhibit their latest products at PAX East, which is happening from May 8-11 in Boston, Massachusetts.
