MoistCr1TiKaL claims his farts were “evidence” in Billy Mitchell v Karl Jobst court case

As a seasoned gamer with a penchant for following gaming-related court cases, I must say that the ongoing saga between MoistCr1TiKaL and Billy Mitchell has been quite an intriguing rollercoaster ride. I remember watching Moist’s “He’s a Cheater” video back in the day, and never did I imagine that his fart would become a piece of evidence in a defamation suit!


In a current legal proceeding, the individual known as MoistCr1TiKal (Charlie) has disclosed that he provided testimony against Billy Mitchell. Remarkably, during this trial, a video clip showing Moist passing gas in front of a camera was presented as evidence disputing his assertions.

The dispute at hand is between Karl Jobst and Billy Mitchell. According to Jobst, the scheduled court date for this case was intentionally postponed by Mitchell for more than three years. It wasn’t until solidified arrangements were made that the trial could commence in an Australian court.

I, being the gamer, am involved in a dispute with Jobst. He’s been posting videos on YouTube accusing me of cheating at Donkey Kong. Now, I believe those accusations are defamatory and have taken legal action to set things right. Specifically, I’m seeking $450k in damages for any harm caused by these false claims.

On the sixth day of the trial, MoistCr1TiKal was called as a witness to testify against Billy Mitchell over a video link. The lawyers for both sides, including those representing Mitchell and Jobst, questioned him about a video that featured Charlie passing gas into a microphone.

Moist clarified, “In this case, a pass from me served as the proof. Billy Mitchell’s group incorporated my ‘musical instrument of the rear’ into their collection of evidence.

In the courtroom, the initial 40 seconds of Charlie’s ‘He’s a Cheater’ video regarding Billy Mitchell were presented, complete with any audible noises, such as flatulence, to serve as a disputed point between the plaintiff and defendant in the case.

In the video, MoistCr1TiKaL stated, “Billy Mitchell doesn’t warrant an apology since Billy Mitchell is not considered innocent. You’re being taken advantage of and deceived by him, as he has been doing throughout his career.

In court, Mitchell’s legal team employed Charlie’s statement to demonstrate the concept known as “rumor chain,” suggesting that Jobst’s videos about the plaintiff triggered Moist to create a video based on what they believe was misinformation. This, in turn, became part of their case for defamation.

MoistCr1TiKaL reinforced his stance in the video’s conclusion, emphasizing that Billy has consistently shown bullying tendencies, exhibited unethical behavior, and possesses a narcissistic personality. He also accused Billy of dishonesty and poor character, stating that his negative reputation has been self-inflicted over numerous years due to his own actions.
