As a seasoned gamer and follower of the latest trends in the world of sports and entertainment, I can’t help but feel a tinge of amusement at the seemingly never-ending saga of trademark lawsuits surrounding Logan Paul and KSI’s Prime Hydration. It feels like they’ve got a bullseye on their backs, doesn’t it?
The logo for Prime X bottles by Logan Paul and KSI’s Prime Hydration is under scrutiny again due to a trademark dispute this time around.
In June, it was announced that the well-known sports beverage brand had launched the Prime X Treasure Hunt competition, with the lucky winner walking away with a million-dollar grand prize.
The hunt included two freshly named Prime Hydration water bottles, themed around the event, which sported a black X symbol at the top. These bottles concealed puzzle pieces within their labels and a secret code beneath their caps.
On Tuesday, Prime’s exciting treasure hunt wrapped up successfully, however, trouble struck the company on November 8th when they were served a lawsuit alleging that the ‘X’ logo on their bottled products infringed upon another company’s trademark.
In simpler terms, the beverage company X Hydration, based in Minnesota, has filed a lawsuit against the drink company owned by Logan and KSI. They claim that the release of their Prime X bottle allegedly violates X Hydration’s logo trademark, causing significant damage (irreparable harm) and further damage will continue if not addressed.
In the lawsuit, it’s stated that the defendant promotes their “X” sports drinks using packaging featuring a logo resembling the X logo of X Hydration, which is legally protected as a trademark at the federal level.
Apart from alleging Prime has infringed on its trademarks following its launch, X Hydration is suggesting that the similarity between the bottle colors of their products (Prime X being available in blue and pink) and those currently offered by X Hydration might also be a point of contention.
The Minnesota-based corporation asserts that the color choices for Prime X were deliberately chosen “to add to the public’s perplexity.” Additionally, they assert that there have been “occasions where consumers have genuinely become confused” regarding the distinction between the two products.
In this case, it is alleged that the defendant’s questionable behaviors were done intentionally, knowingly, cruelly, and without good intentions, with an aim to deceive customers and cause harm to X Hydration.
Prime Hydration has not responded to the lawsuit as of writing.
Apart from the current trademark dispute, they’ve encountered similar legal issues regarding their brand in 2024 as well. As far back as August, NASCAR driver Caesar Bacarella initiated a lawsuit against Prime Hydration, alleging that they infringed upon the trademark of his supplement company, Alpha Prime.
In July, the U.S. Olympic & Paralympic Committee took legal action over a trademark issue. The dispute stemmed from Prime releasing a special edition Kevin Durant water bottle, which highlighted his Olympic accomplishments on its label.
In October, Lionel Messi’s beverage brand ‘Mas+ by Messi’ initiated a legal action against Prime Hydration, aiming to secure a court ruling stating that Mas+’s bottle design does not resemble that of Prime’s. The lawsuit asserts that Logan Paul’s previous scandals and his role in promoting the drink would make it clear to consumers that the two drinks are distinct products.
