On Tuesday, a stunt artist filed a lawsuit against Kevin Costner, claiming that during the filming of “Horizon 2,” they were compelled to carry out an unscheduled sexual assault scene lacking necessary safety measures.
Devyn LaBella served as the principal stunt performer for Ella Hunt’s character, Juliette, in the “Horizon” movie series. As stated in LaBella’s legal claim, it was Costner, the film director, who spontaneously created a scene where Hunt’s character was portrayed as being sexually assaulted.
The scene was declined by Hunt, the lawsuit claims. In his place stepped LaBella, unexpectedly, without prior notice, preparation, or consent, and without an intimacy coordinator being present, as alleged in the complaint. According to the document, the male actor was ordered to climb on top of her, restrain her, and roughly pull up her skirt. The set remained open, the suit states.
According to the complaint, LaBella was humiliated and traumatized by the experience.
On that particular day, I found myself vulnerable, without defense, and profoundly hurt by a system that had vowed security and expertise. The incident has broken my trust and significantly altered my approach within this profession.
The lawsuit claims that the depicted scene disregarded the agreed-upon guidelines set by SAG-AFTRA, which included provisions such as providing a minimum of 48 hours’ advance notice and obtaining consent for any scenes featuring nudity or simulated sexual acts.
The event occurred on May 2, 2023, at a filming location in Utah. It’s also claimed in the lawsuit that LaBella participated in a simulated rape scenario the day before, which was handled appropriately. During this scene, there were rehearsals, an intimacy consultant was present, and the set was sealed off.
As one of the lawyers representing the plaintiff, I can assert that this situation unequivocally illustrates the entrenched sexism and male-dominated culture in Hollywood film production. Regrettably, our client experienced reprehensible sexual misconduct with no safeguard against the evident danger it posed.
Through his legal representative, Marty Singer, Costner dismissed the accusations. According to Singer’s statement, Costner consistently prioritizes ensuring a comfortable work environment for everyone involved in his movies and places great emphasis on safety during filming.
Despite Devyn LaBella’s assertion, it holds no weight at all and directly opposes her own behaviors, as well as proven facts, according to Singer. It is important to note that Ms. LaBella has a history of accusations in the entertainment industry and often collaborates with the same attorney on these claims. However, her questionable tactics will not be effective in this particular instance.
As stated by Singer, the situation was clarified to LaBella, following a practice session. Afterward, she signaled her agreement to her stunt supervisor by giving a thumbs up, showing that she was prepared to shoot the scene “should it be necessary” (although this wasn’t actually required of her).
That night, as per Singer’s account, LaBella joined the stunt coordinators for a meal and seemed cheerful. He did not voice any concerns or complaints to them.
LaBella’s lawsuit presents a different account of the situation, stating that she sought to understand why the event in question was permitted to transpire.
In the lawsuit, it’s stated that after she voiced her anger and worry, the men present accused her of not speaking up earlier. This left her feeling isolated and disheartened, but since filming hadn’t wrapped yet, Ms. LaBella had to maintain a professional demeanor and continue working.
Over the following days, I found myself frequently moved to tears, alluded to in her court documents. The awkwardness was palpable as fellow crew members approached me, offering their apologies for Costner’s inappropriate actions, as detailed in my lawsuit. In the aftermath of this harrowing ordeal, I sought solace and healing through therapy sessions.
James Vagnini, one of the lawyers representing the plaintiffs, stated that the purpose of the lawsuit is to tackle the “shortcomings at the top echelons of Hollywood production firms in recognizing and addressing the effects of acting in sexually explicit and violent scenes, and the necessity for ‘intimacy coordination’.

Based on the claim, LaBella was not rehired for “Horizon 3” and hasn’t been employed in any of the coordinator’s subsequent projects. However, she had a regular working relationship with him prior to this period.
