In-N-Out sues YouTuber for posing as employee & making “bizarre” claims in prank video

The fast-food chain, In-N-Out Burger, is filing a lawsuit against a YouTuber due to an unusual video he posted on his channel that the company finds disturbing.

On June 20th, a burger restaurant filed a federal lawsuit against YouTuber Bryan Arnett. The lawsuit claims that Arnett pretended to be an employee at the chain, bullied customers, and published videos containing allegedly defamatory, insulting, racially insensitive, bizarre, and lewd content online.

The legal dispute originated from a YouTube video that Arnett uploaded back when it was still private on April 25th. According to the Los Angeles Times, this video showed Arnett donning In-N-Out’s distinctive uniform – a white T-shirt, red apron, and cap made of paper – while he simulated operating the drive-thru at several locations on Easter Sunday, when they were actually closed.

During a practical joke, Arnett distributed fake menus, secretly recorded customers without their knowledge, and made unsettling remarks, as stated in the lawsuit. According to legal records, he falsely accused In-N-Out’s food of containing cockroaches and condoms, and claimed that employees would walk on lettuce with their feet.

In a TikTok video, Arnett pretended to find a mock cockroach and informed viewers the restaurant was dealing with a significant infestation. At another point, he asked a customer if they’d like to share a bed with his wife, saying “I enjoy watching my wife sleep with other men. Would that be something you’re interested in?

In-N-Out claimed that Arnett disregarded numerous removal notices and ultimately posted the content on his YouTube channel with over 330,000 subscribers regardless.

The company aims to secure a lasting prohibition against Arnett gaining access to any of its premises, collect all earnings generated by the video, and pursue further monetary compensation for any related losses.

Through the initiation of this court case, we aim to make it clear to anyone involved that In-N-Out Burger intends to take strong legal action against those parties in the future. This was expressed by our Chief Legal & Business Officer, Arnie Wensinger, in a public statement.

In a since-removed additional video, Arnett admitted that he might have overstepped boundaries, expressing, “When I made the video and went out to film it, I was aware of the deep waters I was treading… I understood I was somewhat testing the limits, taking things a bit too far.
