However, this case was moved from the State Court to the Federal Public Prosecutor’s Office. In the end, it was the pilots of Flight 3054, Kleyber Lima and Henrique Stefanini Di Sacco, who faced charges.
When formal charges were filed against the pilots, the prosecution opted to accuse three others instead: Marco Aurélio dos Santos de Miranda e Castro, TAM’s director of flight safety, Alberto Fajerman, the company’s vice president of operations, and Denise Abreu, the head of Anac. The prosecution claims that these individuals neglected to address critical safety concerns, like the runway’s poor grooving and operating the airport under dangerous conditions. However, the legal process was prolonged and intricate, eventually resulting in all defendants being cleared due to a lack of substantial evidence and procedural flaws.
Despite the court’s decision to acquit, the families of the victims, organized under AFAVITAM (Association of Relatives and Friends of the Victims of TAM Flight JJ3054), persisted in their quest for accountability and remembrance. Five years following the crash, their tireless efforts culminated in the creation of a memorial at the crash site, centered around a mulberry tree that miraculously survived the explosion. To this day, AFAVITAM stands, with members gathering annually to honor the victims, ensuring that the lives lost on Flight 3054 remain etched in memory and the insights gleaned from the tragedy guide future aviation safety protocols.
