The judge has decided that a copyright dispute over Destiny 2 will proceed, even though Bungie tried to throw out the case.
2024 saw a legal dispute emerge when science fiction author Casper Cole (real name Matthew Martineau) accused the game developer of stealing parts from his unpublished blog posts, which he writes under the pseudonym Casper Cole, in the original Red War campaign of Destiny 2.
As a devoted fan, I’ve learned that in an early disclosure, David Aldridge, Bungie’s head of engineering, expressed that the campaign at hand was no longer functional because its outdated code was incongruous with the current live version of Destiny 2. Consequently, it couldn’t be compared side by side with Martineau’s content due to this incompatibility.
In November 2020, when Beyond Light expansion was launched for Destiny 2, the Red War campaign was taken out.
Bungie proposed using user-generated YouTube compilation videos and content from the Destinypedia Wiki as alternatives, but these suggestions were eventually turned down.

Judge denies request for dismissal
According to records from The Game Post, a judge in Louisiana chose not to dismiss Bungie’s case on May 2nd.
In simpler terms, the 16-page decision stated that since YouTube videos and additional resources were deemed as third-party, unauthenticated, and not explicitly pointed out by Martineau, they could neither be presented nor serve as a valid alternative to the primary sources of information.
As a supporter, I’ve learned from the summary that the court won’t take into account the documents attached to the Defendant’s motion to dismiss at this point. This is because there hasn’t been enough time for discovery yet and these attachments were originally created by someone else. The authenticity of these documents has not been verified as of now.
In simpler terms, Martineau referred to the YouTube videos Bungie submitted as brief clips that are just copies of other people’s work related to Destiny 2, and they don’t replace the real infringing game. Similarly, Destinypedia excerpts were described as content produced by anonymous Destiny fans, which was randomly uploaded to a different website without official endorsement.
It’s not yet clear what should be done next. The accusations made by Martineau are substantial enough to let him pursue his lawsuit for copyright infringement.
