In a recent development in the ongoing legal dispute between actors Blake Lively and Justin Baldoni, Lively has chosen to withdraw her allegations of emotional distress towards Baldoni. The initial filing from June 2 indicated that Lively sought to have two of her claims against Baldoni dismissed, without barring future similar claims.
Originally, Lively had the option to resubmit her claim at a later time; however, U.S. District Judge Lewis Liman denied her motion on Tuesday, stating that it was based on her promise to withdraw the relevant claims. This decision prevents Lively from filing emotional distress claims again in the future. The two specific claims Lively seeks to withdraw are “intentional infliction of emotional distress” and “negligent infliction of emotional distress.
Esra Hudson and Mike Gottlieb, energetic legal representatives, declared in a statement that the allegations are being dropped because “they are no longer required,” but they will persist in seeking compensation for emotional distress via other claims in her lawsuit, specifically those related to sexual harassment and retaliation. The lawyers emphasized that the Baldoni-Wayfarer approach of filing counter-retaliatory claims has left them vulnerable to extensive damages as per California law.
Baldoni’s Attorneys Requested Medical Information
In my movie-loving perspective, I’d put it like this: “Previously, one of Baldoni’s lawyers, Kevin Fritz, sent a plea to Judge Lewis J. Liman in the U.S. District Court Southern District of New York, asking for an order that would require Blake Lively to disclose her healthcare providers. He also asked for a HIPAA release to gain access to therapy session records and other relevant information.
In addition, the letter mentioned that instead of following through, the star asked for the emotional distress claims to be dropped without any consequences. Baldoni’s team argues that this action implies that Lively will not reveal the necessary information and documents to challenge the claim that she experienced emotional distress. Consequently, they contend that she will preserve the option to refile her (infliction of emotional distress) claims at an undetermined time in this or another court after the discovery period has ended. The letter also pointed out that “Ms. Lively cannot enjoy the benefits of both options.
Lively’s Attorneys: The Withdrawals are “Routine”
As a film critic, I find myself compelled to echo their sentiments. This litigation dance we’re witnessing is nothing more than a regular part of the legal process, often used as a publicity gimmick. Much like any trial attorney, Hudson and Gottlieb are meticulously preparing their case for court, streamlining and focusing it. Simultaneously, the other party seems to be in hot pursuit of another round of sensational headlines in the tabloids.
Regarding the demand for me to retract the two allegations against Baldoni, I am persisting in my assertion. In addition to these accusations, I am also claiming emotional distress, which is one aspect of a larger suite of issues in my lawsuit, such as sexual harassment and retaliation. Furthermore, I am seeking substantial additional compensatory damages on all claims.

Lively First Filed Her Complaint in December 2024
The situation has been unfolding in the media following Lively’s initial sexual harassment accusation against the former actor from “Jane the Virgin,” who she claimed tarnished her reputation. Baldoni, who is also the director of the film adaptation of the best-selling novel “It Ends with Us” and is married to another person, countered by accusing Lively of extortion, defamation, among other things.
