On October 21, 2021, while filming a Western movie called Rust, I found myself in an unexpected and tragic situation. The gun I was handling, a prop revolver, discharged unintentionally. The bullet, unfortunately, struck the cinematographer, Halyna Hutchins.

1) The bullet struck Souza in his arm too, yet miraculously, he managed to survive the terrible event. Unfortunately, Hutchins didn’t make it through. A fresh documentary sheds light on the events of that fateful day and its aftermath, relaying the stories of those who experienced it firsthand.

Throughout the ongoing court case, the spotlight stayed on Gutierrez’s position as the armorer and Baldwin’s roles both as an actor and a movie producer.

Did Alec Baldwin go to prison?

In July 2024, the charges against the actor were dropped and he was not given a prison sentence, since the case was dismissed “with prejudice.” This ruling indicates that Baldwin cannot be tried again for these specific allegations.

In January 2023, Baldwin was officially accused of involuntary manslaughter related to Hutchins’s passing. Initially, he could have been sentenced to spend as long as 18 months behind bars if found guilty.

In October 2021, on the movie set in Santa Fe County, my office has officially charged Alec Baldwin and Hannah Gutierrez-Reed with involuntary manslaughter for the death of Halyna Hutchins. This was announced by the First Judicial District Attorney at the time.

Charges for negligent handling of a potentially lethal item were additionally brought against the assistant director, David Halls. He has admitted to this charge but the terms of his plea deal are still waiting to be officially approved.

In April 2023, the involuntary manslaughter case against Alec Baldwin was dropped without any restrictions, due to the emergence of fresh evidence suggesting that the firearm may have been altered prior to the fatal incident, casting doubt on its original condition.

Without any bias, it was possible that charges could be revisited at a later time – which is exactly what happened. In January 2024, a new grand jury indicted Baldwin once more for involuntary manslaughter. This decision was made after further analysis of forensic evidence suggested the gun was operational during the incident and it’s believed that Baldwin did indeed pull the trigger.

Yet, barely a few days into the trial, the accusations were dropped permanently when it emerged that the prosecution failed to disclose crucial evidence to the defense.

Judge Mary Marlowe Sommer remarked earlier that the late emergence of this evidence compromised the basic justice of the case. Since it’s impossible for the court to rectify this situation, the appropriate course of action is to dismiss the case.

The deliberations were described as “bizarre,” with many feeling justice was not served. 

Lawyer Kari Morrissey initially filed an application to reactivate the charges, however, this request was withdrawn in December 2024, thereby marking the end of the legal proceedings in this particular case.

The District Attorney’s Office praised Morrissey for her significant work on two high-profile cases, one of which resulted in the successful prosecution of Hannah Gutierrez Reed. The DA’s office also expressed support for the Hutchins family as they continue their pursuit of justice in a civil court.

Where is Hannah Gutierrez now?

As I sit here, I’m currently serving a 18-month sentence at a women’s correctional facility in New Mexico. I was found guilty of involuntary manslaughter and my earliest possible release date is September 2025. However, even once I’m out, I’ll be under close supervision to ensure a smooth transition back into society.

In her role as the chief gun handler on the movie set of “Rust,” Gutierrez was tasked with maintaining firearm safety throughout filming. Yet, when it emerged that real bullets were intermingled with fake ones, she faced criticism due to this mix-up resulting in a fatal incident.

In the court proceedings, it was asserted that Gutierrez neglected to adhere to fundamental safety guidelines, including thoroughly inspecting the ammunition and ensuring Baldwin had the necessary gun handling skills. On the other side, the defense contended that she was overwhelmed with work and underprepared, laying blame on the movie’s budget constraints for compromising on safety measures.

Back in March 2024, I was part of the juror pool that determined Gutierrez’s fate. We found her guilty of involuntary manslaughter. Later on, the judge handed down a sentence – a full 18 months behind bars, which was the maximum penalty for the crime she had been charged with.

As a gamer, I found myself in a tricky situation a few weeks prior to starting the filming of Rust, when I was apprehended for carrying a firearm into a bar in New Mexico. This separate weapons charge added another layer of complexity to my life.

At first, she declared herself innocent, but subsequently switched her plea for the advantage of a lighter sentence. This concession granted her the start of an 18-month term under supervised probation while serving time in prison.

Last Take: Rust and the Story of Halyna sparks strong reaction

During the Final Analysis: Rust and the Tale of Halyna, critics have applauded its evenhandedness; however, some spectators of this true crime documentary series harbor doubts regarding the verdict’s credibility.

On Reddit, someone posted, “After watching the Hulu documentary, I find it horrific and heartbreaking that such an incident could occur. I still can’t fathom how live ammunition was present on the set.

It didn’t sit well with me that Alec seemed to lack guilt during his interview with George Stephanopoulos. Regardless of who might be at fault, I find it hard to imagine someone not experiencing some sense of guilt.

The other person responded, “It was fair. I’m relieved they covered all the budget reductions and past infractions… at least it’s shedding light on how flawed the process was and how preventable some of these issues could have been.

I feel like Baldwin received too lenient treatment in this case. While I can see why the filmmaker would want to avoid making it solely about Baldwin given the focus on Halyna, I wish more people were aware of his negligence – such as skipping training sessions, taking charge and pressuring crew members, and potentially pulling the trigger, which both the FBI and gun manufacturer claim was the only way the gun could have discharged.

However, given that the case was dropped permanently and cannot be reopened, it seems there might not be a significant benefit in exploring it extensively further.

As a fan, I couldn’t help but feel that the movie could have delved into the alarming incompetence displayed by the investigators and prosecutors. However, it seems evident that the director had a different focus in mind, choosing not to explore this aspect extensively to maintain the intended narrative.

Another person chimed in, “Dave Halls admitted his guilt for giving the gun to Alec when Hannah wasn’t there. If you watch interviews with him, like the one on Hulu now, you’ll notice that he still appears deeply troubled by his actions.

Baldwin was less involved, and his public relations team skillfully crafted an explanation to downplay the true events of that day.

He was fortunate to have lawyers capable of securing his acquittal through a procedural technicality. The inefficiency and lack of competence shown by the investigators and prosecutors were so significant that, if the true facts had been presented to a jury, I am almost positive he would have been convicted.
