Mother told it’s “impossible” to know which identical twin is the father of her baby

A woman who had relationships with identical twin brothers in quick succession has learned that courts can’t figure out which twin is the father of her child. Standard DNA tests can’t tell the brothers apart, making paternity impossible to determine at this time.

A strange case involving a child’s fatherhood went to London’s Court of Appeal. The mother and one of a pair of twins questioned why the birth certificate listed the other twin as the father.

As a fan of fairness, I really agree with the point that just because someone is legally registered as a twin doesn’t automatically mean they should have parental rights, especially if there’s no scientific proof they’re actually the biological father. It just doesn’t seem right to assume that connection without evidence.

Either twin could be the dad

Appeal court judges have determined the child’s father is one of a pair of identical twins, but standard tests can’t pinpoint which twin. The court was told that both brothers had sexual contact with the mother within a four-day period when the child was conceived, meaning either man could be the father.

In his written decision, Sir Andrew McFarlane explained that determining the child’s parentage is a simple yes or no question, not something open to interpretation. While future technology might eventually pinpoint the father, the expense of that level of testing is currently prohibitive.

The court determined that the man currently listed as the father on the birth certificate doesn’t have legal parental rights, based on the evidence presented. Therefore, his parental responsibilities are temporarily suspended while the case is ongoing.

However, the judges could not rule that he is not the father, either.

Okay, so this whole situation with the kid’s dad is still up in the air. The court’s basically saying it could be either one of the twins right now. They need some solid proof – like a DNA test or something in court – to figure out who the actual father is for sure. It’s a bit of a cliffhanger, honestly!
