
A Florida woman won over $14 million in a lawsuit after a jury determined she was severely injured by eating ice cream that contained metal nails and pieces of metal.
In 2018, Brandy Buckley purchased a butter pecan ice cream from a Bruster’s in Palm Bay and was shocked to find pieces of metal instead of nuts inside.

Buckley said she had already taken a bite when she noticed something unusual.
Buckley explained to WESH 2 News that he felt something get lodged in his throat after swallowing. He initially believed it was a piece of pecan, as he had just eaten butter pecan ice cream.
Buckley later learned she had swallowed a nail after going for an X-ray.

During surgery, doctors took out a nail and several pieces of metal. Unfortunately, she experienced complications afterward, including internal bleeding and a blood clot, which required additional treatment and resulted in the loss of her ability to have children.
“That was my goal, and my dream was to have more kids,” she said.
The 2019 lawsuit claimed the ice cream had unusual and unwelcome items in it and should not have been sold to customers.
The jury in Brevard County awarded Ms. Buckley over $14 million to cover her medical bills and the lasting effects of her injuries.
Throughout the legal proceedings, the companies maintained they weren’t responsible and claimed the product functioned as intended. They still have the option to appeal the decision.
