TikToker ordered to pay $1.75M for destroying couple’s marriage

A TikTok creator from North Carolina has been ordered to pay $1.75 million after a jury found she caused a couple to divorce due to an affair. The creator has millions of followers on the platform.

In 2024, influencer Brenay Kennard (LifeOfBrenay) was involved in a lawsuit filed by her future husband’s ex-wife. The ex-wife claimed Kennard had an affair with him, leading to the end of their marriage. Kennard is a popular social media personality with almost 3 million followers on TikTok and Instagram, where she shares videos about lifestyle topics, makeup, cooking, and food reviews.

Akira Montague filed a lawsuit alleging that Kennard had an affair with her husband, Timothy Montague, while they were still married, prior to their divorce.

North Carolina is unusual because it still has laws allowing someone to sue another person for interfering with their marriage. These laws, originally from the 1850s, let a spouse seek financial compensation from anyone they believe caused problems in their relationship.

Court documents reveal Akira claims Kennard openly displayed their relationship, created content with Timothy while he was still married, and shared photos of her children without her consent. Akira also asserts Kennard intentionally tried to attract Timothy and openly showed off their alleged affair online and in person.

Honestly, it was shocking to hear Timothy testify in court. He basically said he never really loved his ex-wife, describing their relationship as more like being roommates. And get this – he admitted he proposed with the cheapest ring he could find! It was a really cold thing to say, and it just felt awful to listen to.

Prosecutors also presented footage showing Kennard allegedly twerking on Timothy in a bathroom.

The case remained a civil matter. Despite the accusations, Kennard did not face criminal charges.

After a year and a half of court proceedings, a Durham County jury ruled against Kennard on November 10, 2025, finding him responsible on both charges.

The court required her to pay $1.5 million because of the emotional distress she caused to someone’s spouse, and an additional $250,000 for having an affair with a married person.
