Nintendo And Amazon Sue For Millions Over Counterfeit Amiibos

As a devoted fan, I’ve been eagerly following the legal battle between Nintendo and Amazon for over a year now. They’ve teamed up to take action against unscrupulous sellers on Amazon who’ve been peddling counterfeit Amiibos and pirated Nintendo cartridges. Now, these two titans are asking the court to impose a hefty $7 million penalty on these copycats through a summary judgment, aiming to protect the integrity of their products and gaming experience for fans like me.

Through Polygon’s report, it was determined that Nintendo and Amazon estimated the sales of counterfeit merchandise or games by these sellers to be approximately $7 million. In essence, both companies claim that they have been adversely affected by these sellers’ actions, and so imposing a penalty equal to three times the profit made ($21,300,158) is deemed a fair retribution.

Neither Nintendo nor Amazon could get a response or appearance from the sellers involved in the lawsuit, which might lead to their motion for summary judgment being granted. The legal argument also suggests that the resulting penalties would serve as a deterrent against future attempts at similar wrongdoing.

Nintendo’s legal team stated that the suggested sum of $7 million is a cautious estimate, leaning towards the lower limit of potential damages due to the defendants’ misconduct. However, this figure is substantial enough to serve as a warning and discourage similar counterfeiting actions in the future.

Nintendo has recently taken steps against a Legend of Zelda fan film and a Costa Rican grocery store named Super Mario. The production of the Zelda project was halted and removed from Kickstarter, while the proprietor of the Super Mario supermarket was permitted to retain the name, as supermarkets fall outside Nintendo’s trademark protection due to their unique classification.

This year, I’m thrilled to hear that the Xenoblade 2 Amiibos and Metal Gear Solid’s Solid Snake figures are being reprinted! With Switch 2 on the horizon, it leaves me wondering if Nintendo might be planning to resume production of new figures.
