
Nintendo has recently obtained a patent, effective from September 2, 2025, which could significantly influence the development of future games inspired by Pokemon. The application outlines a system that pertains to a key gameplay element involving the summoning of characters and allowing them to engage in battles within a video game.
The application for a patent (submitted through Games Fray) was submitted in March 2023 and approved by the United States Patent and Trademark Office without any challenges. The patent seems to be centered on games similar to Pokemon, as suggested by its detailed description and illustrations. However, there’s apprehension that the broad language of the patent might enable Nintendo to take legal action against other game companies if their games have mechanics resembling those of the patented one in a vague manner.
As a gamer, I might say: “While it’s unlikely that Nintendo will sue companies like Atlus or Square Enix for their established summoning games like Persona, Shin Megami Tensei, and Final Fantasy, the existence of their patent could potentially dampen the spirit of innovation among smaller studios, given Nintendo’s reputation for being litigious.
The developers of Palworld, Pocketpair, have been under scrutiny by Nintendo since the release of their game in early access, following a lawsuit filed by Nintendo in Japan. In a statement, Nintendo stated that they were pursuing legal action for an injunction to halt infringement and seek compensation for damages, alleging that Palworld violated several patents. The specific patents at issue are No. 7545191, No. 7493117, and No. 7528390.
Recently, Pocketpair has significantly altered Palworld, such as eliminating Pal Spheres – items resembling Pokeballs used for monster capturing, and the feature allowing Pals to glide. In reference to the lawsuit filed against them earlier this year, John Buckley, the community manager, expressed that it was a “disheartening day” for the studio when they were sued.
