Man sues restaurant after promotional TikTok video exposes his secret affair

An Italian man is suing a restaurant because a TikTok video filmed there exposed an affair, leading to his divorce.

A 42-year-old man from Catania is suing a restaurant, saying they shared video of him eating with someone else online without his permission, as part of a promotional post. He claims this violated his privacy.

The man reportedly told his wife he was going to a normal business dinner. However, he actually went on a date with someone else at a restaurant.

Venue staff recorded the interaction while filming promotional material. They then posted the video to TikTok without asking the customer for permission or even letting them know.

The man’s wife saw the video as soon as it was posted online. She immediately said she was leaving him, effectively ending their marriage and, according to reports, asking him to move out.

Now, Italian consumer rights group Codacons says it is seeking damages on his behalf.

Francesco Tanasi, speaking for the organization, stated that the restaurant broke the law by recording customers and posting the footage online.

Tanasi explained that posting a video can sometimes severely impact someone’s personal and family life.

He also cautioned restaurants that they need clear permission from customers before using their image or likeness in any advertising or promotions.

Tanasi stated that it’s unacceptable for a restaurant to film customers and share the video online without their explicit permission, as this could lead to unforeseen problems for the individual.

Codacons is also considering filing a complaint with Italy’s data protection authority. They state the man didn’t consent to being filmed and was unaware he was being recorded.

If the complaint proves to be valid, the restaurant might have to pay extra fines according to Italy’s data privacy rules.

TikTok has become known for uncovering relationship issues, and this isn’t the first time the platform has exposed an affair – it’s almost become an accidental detective for people’s love lives.

Last year, Andy Byron, who was then the CEO of Astronomer, received significant media attention when he was photographed with a woman who wasn’t his wife at a Coldplay concert. Shortly after, he and his wife announced their divorce.

In 2024, two women realized they were both dating the same man, and their relationships ended after they discovered the overlap on TikTok.

A bartender went viral years ago after sharing the story of how she accidentally revealed a customer’s affair to his wife.
