Judge dismisses lawsuit from diner who claimed taco shop salsa was too spicy

A German tourist, Faycal Manz, sued the popular New York City restaurant Los Tacos No. 1, claiming he was injured after eating their spicy salsa. He reported burns to his mouth and tongue, and also experienced stomach problems.

The lawsuit argued the restaurant failed to warn customers about the sauce’s heat level.

Judge says spice is “often the point” of salsa

Court documents show that Manz said he was injured after eating salsa at the restaurant while visiting New York in 2024 and is suing for damages, claiming the restaurant didn’t warn him about potential risks.

The restaurant won its case after Judge Dale E. Ho made a ruling in its favor at the U.S. District Court for the Southern District of New York.

When dismissing the lawsuit, Judge Ho pointed out that spicy salsa is a common part of Mexican food. He explained that salsa is frequently made with ingredients that give it a kick.

Judge David E. Ho said Manz hadn’t asked the restaurant about the salsa’s spice level or for a sample before placing his order.

He also stated the restaurant wasn’t required to warn customers about something that was clearly a part of the food. Regarding the salsa, Ho explained in his decision, the spiciness is often what people expect and enjoy.

The judge also noted that Manz hadn’t inquired about the spice level or tasted the salsa before serving it. Judge Ho explained that a simple online search for terms like ‘Mexican food,’ ‘salsa,’ or even reviews of Los Tacos would have shown that salsa is often quite spicy.

The judge ultimately ruled in favor of the restaurant, effectively ending the lawsuit.
