The U.S. Supreme Court has supported a forthcoming prohibition on TikTok, deciding that the congressional action does not infringe upon First Amendment rights regarding free expression. This means the ban is expected to commence on Sunday, January 19, even though it might not be enforced immediately.
In a ruling without named justices, the Supreme Court concluded that the government had given a valid reason for gathering data and ensuring national security. This decision triggered the first attempt to prohibit the app’s usage in Congress, as a joint effort by both political parties. However, TikTok may continue to operate if it manages to find an American buyer before the specified deadline. The ban is scheduled to commence tomorrow, on the eve of President-elect Donald Trump’s inauguration.
Despite the ban on the app being approved by Congress and ratified by President Biden last year, it appears that Biden will not enforce this ban in his final day of office. This leaves the future of the app in Trump’s hands, who has expressed a desire to keep the app accessible in the US. Trump hasn’t shared a detailed strategy for bypassing the ban yet, but he did ask for an extension from the court previously. The law provides a 90-day suspension if there are advancements toward a sale, and several potential buyers have reportedly expressed interest in purchasing the app.
TikTok, a popular social media platform, is operated by ByteDance Ltd., a company that has faced criticism over its connections with the Chinese government. During court proceedings, lawyers representing ByteDance stated that finding a suitable buyer for the company would be challenging due to Chinese laws restricting the sale of their unique algorithm – an essential component powering TikTok’s functionality. As a result, TikTok is planning to cease its operations in the United States starting from this Sunday.
