Coffee company sues Liquid Death over coffee that it doesn’t actually plan to release

A coffee company is suing Liquid Death, the sparkling water brand, to try and stop them from launching a new line of coffee beverages.

Liquid Death is famous for its canned sparkling water, but they also make other drinks, including tea, and plan to launch a line of energy drinks in January 2026.

I’m seriously obsessed with this company right now! They’ve been all over my feed because of their crazy good flavor combinations – sparkling water that actually tastes like Hot Fudge Sundae and Fruity Pebbles? It’s amazing!

Okay, so Liquid Death is at it again with the crazy names! They’ve actually filed a trademark for ‘Liquid Death Deathuccino’ – which, yeah, it’s coffee-flavored, obviously. But apparently another company isn’t thrilled about it, and they’re making their feelings known. It’s getting interesting!

Liquid Death sued by Death Wish Coffee

On October 7th, Death Wish Coffee filed a lawsuit to stop Liquid Death from selling its new coffee drinks, arguing that they would confuse shoppers and damage Death Wish’s reputation and brand.

Death Wish Coffee is suing Liquid Death, claiming they are trying to confuse customers by releasing similar coffee drinks under the ‘DEATH’ brand and unfairly benefiting from Death Wish’s established reputation.

Liquid Death, the company known for its sparkling water, is expanding its brand. It recently filed trademark applications with the U.S. Patent and Trademark Office to include coffee and coffee-flavored drinks, registering both “LIQUID DEATH” and “LIQUID DEATH DEATHUCCINO”.

The complaint also stated that Liquid Death is planning to launch a coffee-flavored beverage after early 2026.

Liquid Death responds to lawsuit

Just two days after the lawsuit was filed, on October 9th, Liquid Death announced it on X (formerly Twitter).

They also claim that they have no plans to actually release a coffee drink.

Liquid Death announced that Death Wish Coffee is suing them to prevent the launch of a Liquid Death coffee brand. However, Liquid Death clarified they don’t intend to release a coffee product at all.

Okay, so this is wild! Death Wish Coffee is actually suing Liquid Death, trying to block us from *ever* making coffee. The crazy part? We weren’t even planning on launching a coffee brand in the first place! 🤷‍♂️ Honestly, it feels like the folks at Death Wish might just be a little *too* caffeinated to be thinking straight…

We don’t think any company should be able to trademark the word “DEATH,” no matter how it’s used, and we doubt we’ll ever get into the coffee business. Liquid Death was recently sued by Death Wish for a product that doesn’t even exist, so feel free to share your thoughts on their lawsuit with Death Wish on social media.

Lawsuits over trademark and design issues in the beverage industry aren’t uncommon. Recently, Prime Hydration, created by Logan Paul and KSI, sued Mas+, Lionel Messi’s drink, claiming their similar packaging was confusing customers.
