Bethesda Game Studios is under allegations for supposedly mistreating their Canadian employees, with a claim of unfair labor practices being levied against the company.

On March 18th, it was confirmed that CWA Canada, an organization representing approximately 6,000 workers in technology, digital media, and print media, had filed a document. The union made this move on behalf of its members, stating the reasons behind the filing as follows:

Regrettably, according to CWA Canada’s official grievances, Microsoft-BGS appears to be engaging in unfair negotiations. They seem to have set restrictive boundaries on who can speak for the union during bargaining, and they’ve made the process unduly complex without a clear justification.

Back in 2021, it became official that Bethesda Game Studios had been bought by Microsoft for a whopping $7.5 billion.

Additionally, the CWA claimed that Microsoft-BGS was withholding details such as employee bonus pay structures and specifics about their Pay Equity Plan, among other pieces of information.

“The union has a legal right to this information for bargaining,” it continued.

In this case, the criticism suggests that Bethesda has not imposed constraints on union negotiations with American workers and has been open in sharing information with them. However, when it comes to Canadian employees, the treatment is allegedly different. The U.S.-based staff have had multiple meetings and have reached preliminary agreements, whereas their Canadian counterparts are said to be treated unequally by the same management personnel.

According to CWA Canada, union workers expressed their dissatisfaction towards Bethesda, finding their unwillingness to collaborate as disrespectful. In a stronger statement, CWA Canada’s President Carmel Smyth asserted that the developer was deliberately treating its Canadian employees with less regard than their counterparts.

Under the Canada Industrial Relations Board, it is considered an unfair labor practice for actions to impede a union’s freedom or capacity to represent its members, or for an employee to be influenced in deciding whether to support a union. Unfair labor practices also encompass actions by unions that hinder an employer’s ability to manage their business operations.
