As a follower who has witnessed the twists and turns of Jussie Smollett’s case, I find myself feeling a mix of emotions upon hearing the news of his conviction overturned by the Illinois Supreme Court. The initial incident, the subsequent charges, the dismissal, and now this latest development – it all seems like a dramatic script from a television show that I can’t seem to turn off.
I’m thrilled to share that the Illinois Supreme Court overturned Jussie Smollett’s conviction for a supposed hate crime hoax, as announced on Thursday.
Last December 2021, an actor known for his role in “Empire” was found guilty on five counts of disorderly conduct. The charges were based on allegations that he had orchestrated a hate crime against himself. He received a sentence of 150 days in county jail, along with three years of probation and a restitution payment of $130,000 the following year. However, his appeal was initially denied by a state appellate court in December 2023. The decision stood that he must serve out his full sentence, during which he had already served six days before being released on bail pending the appeal. Recently, the Illinois Supreme Court has decided to review his appeal.
Back in January 2019, Jussie Smollett claimed to authorities that he was attacked near his Chicago apartment complex by two unknown individuals. They allegedly hurled racist and homophobic slurs at him before putting a noose around his neck. Following an investigation, the police accused Smollett of orchestrating this attack with the help of two acquaintances, leading to charges for filing a false police report. However, in March 2019, all charges were dropped as part of a deal between Smollett’s legal team and the Cook County prosecutor, which involved community service and forfeiting his $10,000 bond. This decision sparked controversy, prompting a separate investigation by the state of Illinois with a special prosecutor who re-indicted Smollett in February 2020. The trial against him began in November 2021, and he was found guilty in December 2021.
On Thursday, as reported by the Chicago Tribune, the Illinois Supreme Court opined that a breach of Smollett’s rights occurred when the special prosecutor chose to re-try him.
The court’s statement, as reported by the Chicago Tribune, acknowledges that there has been extensive public concern and dissatisfaction about the initial outcome of this case, with many viewing it as unfair. However, it also emphasizes that a decision from this court which suggests that the state is not obligated to uphold agreements that others have relied on detrimentally would be even more unjust than resolving any one criminal case.
